Orientation Occupancy Agreement
This document sets forth the terms and conditions under which space in Merrimack College (herein called the “College”)-owned buildings (townhouses, residence halls, and apartments) may be occupied by the undersigned individual (herein called “Attendee”).
Assignment of Space
The College by this contract does not guarantee specific halls, rooms or roommates and reserves the right to assign or re-assign Attendees of other rooms in the best interests of the College. The College may also cancel this contract at any time for an Attendee found in violation of any rules and regulations applicable to the above or if the Attendee poses danger to themselves or others as determined by the College’s representatives. Space assignments are non-transferable, and occupancy by a student or other person without authorization is not permitted. Attendee may not transfer an assignment, share, or sublet assigned space without authorization.
Condition of Room
Attendee is responsible for the care and use of the assigned space. The Attendee must observe all rules and regulations applicable to this Agreement and any other published rules, policies or procedures that have been promulgated by the College, which are incorporated herein by reference and made a part of this contract.
Inspection of Room
The College reserves the right to inspect an Attendee’s room and belongings. An Attendee’s room may be entered by authorized College personnel or authorized agents of the College whenever there is a reasonable cause for concern regarding the safety, health and/or well-being of the individual occupants, if there is a reasonable suspicion that College policy has been violated; to perform damage assessments and/or repairs; to inspect for fire and safety violations; or for other necessary reasons. When feasible, the Attendee will be notified in advance of any such inspections. College Officials, including College Police Officers, will have access to lobbies, hallways and other common areas for inspections and patrol, with or without advance notice.
Non-Liability for Student Property
The College shall not be liable for any damage to or loss/theft of any Attendee’s personal property from any cause whatsoever, nor for the failure or interruption of utilities or computer and internet systems. The College does not carry insurance for the personal property of Attendees, and the Attendee is strongly encouraged to have Attendee’s personal property covered by Attendee’s own insurance.
An Attendee is required to comply with all rules and regulations of the College, including, but not limited to, those rules and regulations as stated in the Student Handbook, which can be viewed at www.merrimack.edu/life/student_handbook.php. Attendee specifically agrees that no alcohol is permitted on campus during Orientation, regardless of the age of Attendee. Attendee further agrees that violation of College policies by Attendee will subject Attendee to immediate removal from College property and any other applicable discipline defined in the Student Handbook.
The Attendee acknowledges that they will be receiving a key(s) and a Mack Card from Merrimack College. Attendee is responsible for the proper usage of these items and will return them upon departure from campus. Attendee agrees not to switch rooms without approval from Residence Life. Attendee agrees that Attendee will not have the key(s)/card duplicated in any form and that Attendee will immediately report the key(s)/ card lost, missing or out of Attendee’s possession for any reason. Attendee further understands that if the key(s)/card is lost that the College may hold Attendee financially responsible to replace the materials. The key(s) costs $75.00 each to be replaced and Mack Card costs $25.00 each to be replaced.
The College may terminate this Agreement and your occupancy in College-owned buildings in the event of any disregard by Attendee of any rules, policies or procedures that have been promulgated by the College.
